In an order approving a settlement of a complex class action case, the presiding judge commended Eric Holland and the Holland Groves Schneller & Stolze law firm for its handling of the case.  The Honorable Tom W. DePriest, Jr.'s order, entered April 15, 2013, found "...based on the appearance of Class Counsel at hearings and filing of pleadings in the case, that Class Counsel's prosecution and handling of this case has been exemplary.  Attorney Holland, who personally appeared at all substantive hearings, demonstrated a command of complex litigation that resulted in the rare opportunity for complete relief for class members.  The Court commends Holland and his firm, Holland Groves Schneller & Stolze, for their prosecution of this action."  The judge's order finalized another settlement in which Holland and the firm sought recovery of improperly charged fees in connection with real estate transactions.  The settlement provided class members with the opportunity for complete reimbursment of all fees charged and included a provision for the defendant to change its practices with regard to the charging and collection of fees.

HGSS founding partner Steven L. Groves has been recognized as one of the St. Louis region's top attorneys.  The recognition comes from St. Louis Magazine's most recent issue, February 2013, which lists the metropolitan area's Best Lawyers 2013 in a variety of practice areas.  Steve was included in the railroad law section, one of his and the firm's central practice areas.  Steve has actively litigated FELA and crossing cases against the nation's railroads for over 20 years and received numerous multi-million dollar verdicts on behalf of injured railroad workers.

After nearly three years of litigation in the United States District Court for the Central District of Illinois, final approval has been granted to a settlement of claims arising from the collapse of the former Taylor Bean & Whittaker mortgage loan portfolio and subsequent take over of the loans by Bank of America.  The settlement, valued by the court at nearly $20,000,000, is providing complete relief to a class of over 10,000 borrowers whose accounts were not credited with payments made in August, 2009 following the take over of the portfolio by Bank of America.  As part of the settlement, all accounts have or are being credited, all late fees are being reversed or refunded, and the class is being provided with a variety of other injunctive relief including corrected tax reporting and credit correction services, among other things. 

Eric D. Holland of Holland Groves Schneller & Stolze, LLC, was appointed co-lead counsel by the court last year and helped lead the case to its successful conclusion, as did Holland Groves partner Gerard B. Schneller.   In its final approval order, the court recognized these efforts as well as the qualifications of counsel, finding that Mr. Holland and his colleagues were "well qualified and competent in the area of complex litigation and nationwide class actions", pointing in particular to the court's "observations during hearings held in this case."  A complete copy of the court's order is available below.

A federal court jury in the Southern District of Illinois returned a unanimous $1.6 million verdict for a railroad conductor who was injured while working for BNSF.  The jury deliberated nearly four hours in reaching its verdict, finding that the railroad was negligent and violated the Locomotive Inspection act in causing the plaintiff's injuries, which included back trouble and a concussion.  The verdict followed a week long trial of the case in Benton, Illinois by HGSS attorneys Steve Stolze, Eric Holland and Seth Crompton.  The multi-million dollar verdict is the fourth straight jury verdict this year in favor of railroad workers represented by HGSS.  The firm represents injured railroad workers across the country in claims arising under the Federal Employers Liability Act (FELA)

A Kansas City, Missouri jury awarded an injured railroad worker $1.3 million yesterday for damages arising from a near collision between a bus transporting workers and an ambulance responding to a call.  The plaintiff was a locomotive engineer for Amtrak and sustained injuries to his neck as a result of the incident.  HGSS partner Steve Groves was lead trial counsel for the plaintiff, who was hurt while "deadheading" or being transported by the railroad's contractor at the time of the incident.  Deadheading incidents raise a number of particular and sometimes complicated legal issues for railroad workers.  For additional information about deadheading injuries or this case, please contact Steve at sgroves@allfela.com or 1-877-ALL-FELA.

Holland Groves Schneller & Stolze has announced the filing of what is believed to be the first federal lawsuit against Carrier IQ arising from the violations of federal wiretap laws. The lawsuit, filed in the Northern District of Illinois, also names phone maker HTC.
